Darakshan police have registered a case against a woman over charges of killing a cat in a 'road accident' in Karachi's Defence Housing Authority area under the directives of the local court, police said on Saturday.

“We have registered a first information report against the woman under Section 429 (mischief by killing or maiming cattle, etc) of the Pakistan Penal Code on the complaint of the lawyer,” said Darakshan SHO Arshad Janjua.

The officer said that the cat was injured when the woman's car hit it in Phase 8 on February 1. It remains unclear if it was someone's pet or a stray.

A lawyer, Faiq Ali, who had witnessed the incident demanded treatment of the wounded cat, but the woman did not agree to take any responsibility. He then approached the police for lodging an FIR against the woman but the police refused to do so.

The advocate later approached the court, contending that animal rights are protected the world over. The police also argued before the judge that if the case can be registered, then the complainant should also be nominated as he allegedly "did not help to shift the injured cat to a veterinary hospital for treatment due to which the cat died".

However, the court rejected the police’s version and directed them to register a case against the errant woman driver.

So far, no one has been arrested in the case.

Section 429 reads: "Whoever commits mischief by killing, poisoning, maiming or rendering useless, any elephant, camel, horse, mule, buffalo, bull, cow or ox, whatever may be the value thereof, or any other animal of the value of fifty rupees or upwards, shall be punished with imprisonment of either description for a term which may extend to five years, or with both."

So the lawyer had time to argue with a woman and approach police and the court but no time to first take the cat some where where she could be saved?

What an egoistic asshole who went to court just because the women might have hurt his ego. Even though the woman was as evil as it gets, because ones heart has to be full of darkness to not see the little things and to not do ones best to make it easy for them instead of killing them.
 
police not book anyone if any human is killed i think this cat belong to some rich politician and their pets have more value than poor public of Pakistan

I love cats but this is just silly. Unless the cat was injured on the roadside and the woman intentionally drove over it, but a cat running into the car is no fault of the driver.

Yes its about the law. All laws must be followed and implemented. That is what is called a just society. Our police, govt and even lower courts have too much belief in the concept of "cosmetic law" law just for shughal and this was highlighted in the recent judgment by the supreme court on faizabad district where the court questioned the ECP as to why due process was not followed in the registration of TLP and he answered bcz some of it was cosmetic law. Wat idiocy. How dare he! This thinking that a select should be implemented and the rest are just eye candy is wrong and is our greatest problem.

The police openly refused to file a case despite it hitting a few sections.. The person had to approach the magistrate..

You see if you go to the police to register a complaint then they are bound to register it. Its the law however if the police refuses to register the complaint and file and FIR then the aggrieved party can file an application for CRPC section 22A/B which will allow the aggreived party to bring the case to a magistrate who will then hear the complainant and order for its registration and with that court order police will have to file the FIR and will have to follow the due procedure of investigation, filling the challan and making a file to bring its investigation to a magistrate.

This is what happened here. There is no rich poor here ( people seriously need to learn laws!!) But the act of the police once again refusing to work, even making arguments wrongly and stupidly may I add ( I expected nothing less from our police) and a person having to go to the courts to get some semblance of justice..


You guys won't believe how common application for 22A/B is in our session courts. Why? Bcz the police doesn't work unless great pressure is placed on them.
 
Not taking the cat to the vet makes her a piece of sht.

Is there even a point in trying to save a cat crushed under a cars wheel? Does that make any sense at all? The most humane thing in that instance would be to end the cat's suffering ASAP.

That would be the thing for the vet to decide and do.

That woman refused to take the cat to the vet.
