اعظم سواتی کیس: ’آپ حاکم ہیں اور محکوم کے ساتھ ایسا سلوک کرتے ہیں‘

پاکستان کے چیف جسٹس نے اسلام آباد پولیس کے سربراہ کی تبدیلی سے متعلق از خود نوٹس کی سماعت کے دوران وفاقی وزیر اعظم سواتی کو مخاطب کرتے ہوئے ریمارکس دیے ہیں کہ ’جو شخص دو وقت کی روٹی کمانے والے غریب آدمی پر ظلم کرے تو ایسے شخص کے طرف سے ڈیم فنڈ میں دی جانے والی رقم کو بھی قبول نہیں کیا جائے گا‘۔

چیف جسٹس نے اس بات پر تشویش کا اظہار کیا کہ جے آئی ٹی کی رپورٹ میں اعظم سواتی کو ذمہ دار قرار دینے کے باوجود حکمراں جماعت پاکستان تحریک انصاف نے ان کے خلاف کوئی کارروائی نہیں کی۔

واضح رہے کہ عدالتی حکم پر بنائی گئی جے آئی ٹی نے غریب آدمی نیاز محمد کے ساتھ جھگڑے کی ذمہ داری وفاقی وزیر اعظم سواتی اور ان کے خاندان کے دیگر افراد پر عائد کی تھی۔ عدالت نے اس رپورٹ کے بعد مذکورہ وفاقی وزیر کے خلاف آئین کے آرٹیکل 62 ون ایف کے تحت کارروائی کرنے کا عندیہ دیا تھا۔

آئین کے اس آرٹیکل کے تحت کسی شخص کو عمر بھر کے لیے رکن پارلیمان بننے سے نااہل کیا جا سکتا ہے۔ سابق وزیر اعظم میاں نواز شریف اور پاکستان تحریک انصاف کے رہنما جہانگیر ترین کو بھی اسی آرٹیکل کے تحت نااہل کیا گیا ہے۔

چیف جسٹس نے اعظم سواتی کے وکیل کو مخاطب کرتے ہوئے کہا کہ ان کے موکل کے خلاف آرٹیکل 62 ون ایف کے تحت ٹرائل ہوگا تاہم عدالت کو صرف یہ بتا دیں کہ وہ یہ ٹرائل کس سے کرانا چاہتے ہیں۔

چیف جسٹس نے وفاقی وزیر کو مخاطب کرتے ہوئے کہا کہ ’آپ حاکم ہیں اور محکوم کے ساتھ ایسا سلوک کرتے ہیں۔`

اُنھوں نے کہا کہ اس غریب آدمی کی بھینس اعظم سواتی کے فارم ہاؤس میں گھسی ہی نہیں تھی جبکہ اس کے بچوں اور خواتین کو اٹھا کر جیل میں ڈال دیا گیا۔

عدالت نے اسلام آباد پولیس کے سربراہ عامر ذوالفقار کی سرزنش کرتے ہوئے کہا کہ اُنھوں نے ابھی تک اس معاملے پر کچھ نہیں کیا۔

اعظم سواتی سے عدالت کے 10 سوال

اعظم سواتی کے وکیل علی ظفر نے عدالت کو بتایا کہ عدالت نے ان کے موکل سے 10 سوالات پوچھے تھے۔ جس میں سے پہلا سوال یہ تھا کہ کیا آئی جی کا تبادلہ اعظم سواتی کے دباؤ پر کیا گیا جبکہ حقیقت یہ ہے کہ تبادلہ پہلے سے ہی طے تھا جس پر بینچ کے سربراہ نے ریمارکس دیتے ہوئے کہا کہ اعظم سواتی کا فون نہ اُٹھانے پر آئی جی اسلام آباد کا تبادلہ کیا گیا۔

چیف جسٹس کا کہنا تھا کہ اعظم سواتی کے خلاف نااہلی کے قانون کے تحت ٹرائل ہوگا۔ سماعت کے دوران سپریم کورٹ بار ایسو سی ایشن کے صدر امان اللہ کنرانی روسٹم پر آئے اور عدالت سے استدعا کی کہ وہ اعظم سواتی کے خلاف نااہلی کے قانون کے تحت کارروائی نہ کریں کیونکہ اعظم سواتی ان کے ساتھ ایک جگہ کام کرتے رہے ہیں جس پر چیف جسٹس نے سپریم کورٹ بار ایسوسی ایشن کے صدر کو مخاطب کرتے ہوئے کہا کہ وہ ایک ایسے ارب پتی شخص کی سفارش کر رہے ہیں جو دو وقت کی روٹی کمانے والے شخص سے لڑائی کرتا ہے۔

امان اللہ کنرانی کا کہنا تھا کہ جرم ضرور ہوا ہے لیکن اس جرم کی اعظم سواتی کو اتنی بڑی سزا نہ دیں۔ صدر سپریم کورٹ بار ایسوسی ایشن نے عدالت سے اعظم سواتی کو معاف کرنے کی درخواست کی۔

سماعت کے بعد سپریم کورٹ کے وکلا نے امان اللہ کنرانی سے ناراضی کا اظہار کرتے ہوئے کہا کہ اُنھیں بحثیت سپریم کورٹ بار کے صدر وکلا کا وزن اعظم سواتی کے پلڑے میں نہیں ڈالنا چاہیے تھا۔

سماعت کے دوران اعظم سواتی کے وکیل کا کہنا تھا کہ ان کے موکل پر اس جرم میں آرٹیکل ون ایف کے تحت کارروائی نہیں کی جاسکتی جس پر چیف جسٹس کا کہنا تھا کہ باسٹھ ون ایف پر عدالت خود بھی شہادتیں ریکارڈ کرسکتی ہے۔

سپریم کورٹ نے اعظم سواتی کے خلاف مقدمے کی کارروائی کو آگے بڑھانے کے لیے سابق اٹارنی جنرل خالد جاوید اور ایڈووکیٹ فیصل صدیقی کو عدالتی معاون مقرر کردیا ہے۔ اس از خود نوٹس کی سماعت 24 دسمبر تک ملتوی کردی گئی ہے۔

اعظم سواتی کے خلاف یہ کیس یہاں تک کیسے پہنچا؟
وفاقی وزیر اعظم سواتی کے بیٹے کی مدعیت میں اسلام آباد پولیس نے پانچ افراد کے خلاف مقدمہ درج کیا تھا جس میں الزام عائد کیا گیا ہے کہ ملزمان نے وفاقی وزیر کے گھر پر حملہ کیا تھا۔

اس مقدمے میں پولیس نے ایک بارہ سالہ لڑکے ضیا الدین کا نام بھی درج تھا تاہم سپریم کورٹ نے آئی جی کے تبادلے کا جب نوٹس لیا تو پولیس حکام نے اس کمسن ملزم کو رہا کر دیا۔

ضیا الدین کا کہنا تھا کہ اُن کی گائے اعظم سواتی کے فارم ہاؤس میں گھس گئی تھی جب اُنھیں واپس لے کر آئے تو مذکورہ وزیر کے کارندوں نے مبینہ طور پر اُنھیں تشدد کا نشانہ بنایا اور مقدمہ بھی اُن ہی کے خلاف درج ہوا۔

دوسری طرف وفاقی وزیر اعظم سواتی کا کہنا ہے کہ ملزمان نے اُن کے ملازمین کو تشدد کا نشانہ بنایا۔

اُنھوں نے کہا کہ اُنھوں نے اسلام آباد پولیس کے سربراہ کو تحفظ فراہم کرنے کی درخواست کی تھی لیکن اُنھیں تحفظ فراہم نہیں کیا گیا۔

یاد رہے کہ وزیر اعظم عمران خان نے وفاقی وزیر اعظم سواتی کا ’کام نہ کرنے اور ان کا فون نہ سننے کی وجہ‘ سے آئی جی اسلام آباد جان محمد کو تبدیل کردیا تھا تاہم سپریم کورٹ نے وزیر اعظم کا یہ زبانی حکم معطل کردیا تھا۔

Okay but you have to choose between two in current situation.

Few people here don't underand that democracy is not about pure clean and bad it's about choosing between
worse vs very bad vs bad.
What will be your pick if you have have to choose from above and no way around. Sitting on home and don't vote it's will do no good will be like thinking of altaf hussain bycott of election will make him good.

Do we have this level of criticism in west also? What Imran khan did I think no one can why I think this? Because who thought we could be free from PMLN slavery at least I didn't. I am still worry about PPP when we will get free from them but I know if anyone can do it's Imran khan. He is not yet guilty of anything or corruption that is enough for me to give him vote. What respect he gets from west and other country where he goes it's another eye opener who other country see Imran khan but never seen respect for any of the party leader in past so he must be something good.
