There should be a clause in all these large commercial deals, that in order for it to be valid (I.e. an expectation Pakistan will pay them back), the terms and conditions need to be transparent and with enough time for opposition to raise objections in a timely manner 30-90 days.

These criminals should be prosecuted in absentia and if found guilt their property confiscate to compensate the state in the event they don’t return the embezzled funds.

The problem with such a clause is that opposition has an incentive to stall, delay, and block large deals that make incumbent gov't look good. Both sides play this game to prevent the other from making any progress.

Such a clause only works in countries where the opposition acts in good faith for the overall benefit of the country like Germany. It will never work in Pakistan where opposition will just use it as more ammo to ask unnecessary questions and delay large deals even more in order to prevent gov't from accomplishing anything meaningful.

The struggle in Pakistan is not only having a gov't that cares about the country but also having an opposition that cares equally about the country.
