Decided to open a thread on Supreme court hearing on Karachi violence , lets discuss defense arguments (to be decided!) , Govt / law enforcement reports ,follow ups and analyze in detail. Hope it help us all in recognizing real perpatrators and reasons behind the non stop unrest and most importantly any solutions and judgement by judiciary. It would be an interesting development lets see how judiciary can help resolve and it would also explain the capabilities of judiciary. :pakistan:

A five- member bench of the Supreme Court (SC) on Monday directed the Attorney General of Pakistan that the reports of sensitive agencies regarding law and order situation in Karachi should be made part of the record.

The SC bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Anwar Zaheer Jamali, Justice Sarmad Jalal Usmani, Justice Amer Hani Muslim and Justice Ghulam Rabbani was hearing a suo moto case regarding law and order situation in Karachi at Karachi Registry.

Inspector General of Police (IGP) Sindh Wajid Ali Durrani apprised the court about the law and order situation through a multi-media screen, which was installed specially for the purpose in the court room.
He submitted the record before the court regarding the violence in Karachi.
The bench expressed its `dissatisfaction’ over the report and observed that the court could not reach a conclusion in the case with the facts presented in the report.

The court asked the IGP as to what investigations had been conducted and who were responsible for the violence in Karachi.
The Chief Justice remarked that the “protection of life and property of the people is responsibility of the government”. He asked as to why the station house officers (SHOs) were not aware of crime in their jurisdictions.

Replying to the queries of CJ, the IGP said that police and ordinary citizens were not allowed to enter some parts of Karachi.
He also informed the court that extortion was a problem which was plaguing the city for the last 10-12 years. The money was received on different pretexts even as `Zakat and Fitra’
.
He said that cases had been registered and 13 accused were arrested on charges of extortion.

The Chief Justice also asked the IGP to give details of smuggling of weapons into Karachi.

About the presence of alleged torture cells in some areas of the city, Wajid Durrani said that the police had not found any. On this the CJ replied that SHOs could be aware of the presence of torture cells.

Attorney General Mulvi Anwar-ul-Haq represented the Federation while Advocate General Sindh Abdul Fatah Malik and senior lawyer Abdul Hafeez Pirzada appeared before the court on behalf of the Government of Sindh.
Former Federal Law Minister Dr. Babar Awan also appeared on behalf of the Federation.
Senior Lawyer Hafeez Pirzada was on his feet when the court adjourned hearing till Tuesday. He will continue his arguments on the next hearing.
The families of the victims of target killings were also asked to volunteer their appearance before the bench and may also submit any evidence, if available.

CJ directs govt to reveal perpetrators of Karachi violence

ISLAMABAD: The Supreme Court on Monday adjourned the hearing of the suo motu case on the killings in Karachi until Tuesday, DawnNews reported.

During the hearing, Chief Justice Iftikhar Mohammad Chaudhry directed the government to apprise the court of the reasons behind and the perpetrators of bloodshed in Karachi.

A special bench of the apex court heard the case on Monday.

Special security arrangements were made for the day and roads leading to the Supreme Court’s Karachi registry had been blocked.

The special bench includes Chief Justice Iftikhar Mohammad Chaudhry, Justice Shakirullah Jan, Justice Nasirul Mulk, Justice Tariq Parvez and Justice Ghulam Rabbani.

Security for SC hearing on killings




KARACHI, Aug 26: As a five-member special bench of the Supreme Court, headed by Chief Justice Iftikhar Mohammad Chaudhary, will start hearing the suo motu case of targeted killings in the city on Monday, special arrangements have been put in place to ensure security at the court premises.

For proper court decorum and smooth functioning of the Supreme Court, entry into the courtroom would be regulated by passes, to be issued by the officer in charge of the Karachi branch registry, said an SC press release issued on Friday night.

It said that passes would be issued to the petitioners, respondents and their counsel appearing in court.

The press release said that the entry of journalists “who regularly cover Supreme Court proceedings would also be made through passes. Any additional demand for journalists` entry could be made to the officer in charge of the Karachi Branch Registry, Supreme Court of Pakistan,” it added.

The press release said: “As regards others, passes will be issued to all those who are interested to watch court proceedings but subject to seating capacity in the said courtroom. Passes to be issued on `first-come-first-serve-basis` may be obtained from the office in charge of the Karachi Branch Registry”.

It said entry into court building would be allo- wed after checking/ frisking and searching of bags/ purses etc.

“No cellphones can be carried inside the courtroom. Special arrangements have been put in place to ensure foolproof security on the premises of the court,” it added.

ISLAMABAD: A day before a crucial Supreme Court hearing on the volatile law and order situation in Karachi, a Muttahida Qaumi Movement (MQM) delegation met the court`s registrar and informed him of the party`s desire to become a party in the suo motu case.



On Friday (today), a special five-member bench of the apex court will commence hearings on the senseless killings in Karachi.

The bench will comprise Chief Justice Iftikhar Mohammad Chaudhry, Justice Shakirullah Jan, Justice Nasir-ul-Mulk, Justice Tariq Parvez and Justice Ghulam Rabbani.

The court has already summoned Attorney General Maulvi Anwarul Haq, Sindh Chief Secretary Raja Mohammad Abbas and Provincial Police Officer Wajid Ali Khan Durrani through Sindh`s advocate general to submit details of the recent killings.

The president of Supreme Court Bar Association and president of Sindh High Court Bar Association have also been asked to assist the court on Friday.

After meeting the registrar, the MQM`s deputy convener, Dr Farooq Sattar, and one of its members of National Assembly, Haider Abbas Rizvi, told journalists that their party wanted to help the court reach the right conclusions in the case.

Dr Sattar said the Muttahida was an aggrieved party as the violence in Karachi had affected it particularly badly.

The MQM may soon submit a formal application to the court in this regard.
 
I dont know what fruit will this hearing bring for the people of Karachi, but lets see....


from yesterday's hearing:

KARACHI: The Supreme Court rejected on Monday the government`s report on targets killings in Karachi and asked the attorney general to place on record reports from intelligence agencies on investigation into the matter.
 
The verdict I await is "Zardari, Gillani, Wali Khan and of course Altaf Hussain are all murderers and have intentionally perpetuated ethnic violence in a turf war on Karachi".
 


I think Najam Sethi's analysis on the situation is upto the mark of standard analysis.

CM duty bound to protect citizens, says CJ

KARACHI: The Supreme Court on Tuesday heard the suo motu case on the bloodshed in Karachi and subsequently adjourned the hearing to September 5, DawnNews reported.

During the hearing, Chief Justice Iftikhar Mohammad Chaudhry said that the province’s chief minister was duty-bound to protect the people of Sindh.

Moreover, Sindh government’s counsel Abdul Hafeez Pirzada presented his arguments before the court.

He said that the security situation had improved since the court’s notice on the issue.

Furthermore, Mr Pirzada stated that the percentage of court convictions was very low and that police and Rangers were not being properly utilised.

Earlier on Monday, the apex court rejected the government’s report on targets killings in Karachi and asked the attorney general to place on record reports from intelligence agencies on investigation into the matter.

The report of the Federal Investigation Agency, Sindh police’s Special Branch and Intelligence Bureau on target killings was submitted by Attorney General Maulvi Anwarul Haq.

The bench expressed dissatisfaction over the report and observed that it did not have facts needed to make headway. Apart from the first three pages, the bench said, it contained newspaper reports without an analysis.

The case is being heard by a five-judge special bench headed by Chief Justice Iftikhar Mohammad Chaudhry.

I dont know what fruit will this hearing bring for the people of Karachi, but lets see....

There is no political solution in sight , We cannot drag military into civil affairs .. leaves us with the judiciary only. It will be a test of their skills as well , will prove if they have any capacity to settle state affairs whilst the rest have failed.

Bringing army into Karachi would amount to a destruction of democratic institutions, says chief justice.
KARACHI: Chief Justice Iftikhar Chaudhry slammed the Sindh government over the rise in Karachi violence during Tuesday’s hearing of the suo motu case on the security situation in the city.

He said that the government has the resources and machinery to restore peace in the metropolis but lacks the will to do so. He directed the Sindh government to act immediately to curb the violence.
A five-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhry ordered Attorney General Anwarul Haq to file a new report, carrying the latest information about those who are creating unrest in Karachi.
Court slams govt
“It is time for the provincial government to wake up,” the chief justice told the Sindh government’s counsel, Abdul Hafeez Pirzada. “The matter has become serious and a fundamental right to security is being violated,” he added.
In hidden words, the CJ said that bringing the army into Karachi to curb violence would amount to a destruction of democratic institutions and stated that the issue should be resolved democratically.

The chief justice questioned Pirzada about the police’s failure to identify victims of target killings, saying that FIRs were registered to unnamed persons.
He also expressed dissatisfaction that none of the accused were presented in Anti-Terrorism Courts, nor were issued a challan by the police. He slammed the police for not recording the statement of an injured victim who was recovered earlier this week.
He noted that the provincial government’s move to borrow federal security forces has proved very expensive. The better alternative, the CJ remarked, was to develop the provincial police force.
The govt’s version
Earlier during the hearing of the suo moto notice case of Karachi violence, the Sindh government’s Counsel Hafeez Pirzada told the court that 2.5 million foreigners are living in Karachi but less than 100,000 have been registered.
He maintained that in recent years, these foreigners have increased their influence and may be blamed for the rise in violence in Pakistan’s heartland.
Chronicling the history of ethnic clashes in Karachi, Pirzada said the Pashtuns and the Muttahida Qaumi Movement (MQM) first clashed in Sohrab Goth during the rule of General Ziaul Haq in the 80s.
He said the local bodies system, introduced by former president Pervez Musharraf, aggravated ethnic tensions in the city.
The hearing of this case has been adjourned till September 5.

KARACHI: The Muttahida Qaumi Movement (MQM) on Tuesday held a press conference in response to the earlier allegations made by Pakistan Peoples Party (PPP) leader Zulfiqar Mirza.
Speaking at MQM headquarter Nine Zero, party leader Faisal Sabzwari said that many people in the past had expressed their hatred for the MQM and party leader Altaf Hussain.
He said the MQM had shown responsible behavior in the wake of Zulfiqar Mirza’s statement and their response showed “manners and culture.”
On breaking Pakistan
On Zulfiqar Mirza’s allegation of Altaf Hussain conspiring with the US to break Pakistan, Sabzwari said that he had made childish allegations that highlighted the “mentality” of the former Sindh senior minister.
“It is a lie that the MQM’s enemies have been narrating since the party was created…it is nothing new…just like the lies regarding the creation of Jinnahpur,” said the MQM leader.
Sabzwari said the MQM had been formed by people whose ancestors had left everything behind for the sake of Pakistan. He added that it was actually Zulfiqar Mirza who had come on the media and said “we want to break Pakistan”.
“Just a few months ago Zulfiqar Mirza had stated that he wished to break Pakistan. This same individual is now making shameful allegations against the MQM.”
Referring to documents held by Mirza and circulating online, Sabzwari said the MQM would defend anything the party had written. He added that only yesterday, the UK High Commissioner said he had no knowledge of a letter sent by the MQM chief to former prime minister Tony Blair which called for disbanding the ISI.
Target killers and terrorists
Speaking on the Joint Investigation Team (JIT) reports that had recently revealed that members of the MQM had been found involved in target killings, Sabzwari said that all criminals should be presented in court and that they were “innocent until proven guilty.”
He said that it was the right of every person to go to court and that Zulfiqar Mirza should also go to court with the allegation he has made and present his proof there.
“Zulfiqar Mirza shouldn’t become a judge and jailer and should go to court” he said.
“This drama was carried out to divert attention from the suo motu hearing of the Supreme Court on the Karachi situation.”
He alleged that extortion and kidnapping rose when Zulfiqar Mirza had taken charge as home minister, adding that 500 MQM workers were killed during Mirza’s tenure.
Sabzwari referred to the Shershah scrap market incident and said the attackers had surrendered but had later been released as the witnesses in the case had been threatened to not come forward. He alleged that the same criminals had later been seen with Zulfiqar Mirza at a Peoples Amn Committee rally, where he had said that they were all his children.
He said that Zulfiqar Mirza had spoken a lot about peace in Karachi when he had taken charge, but he spoke up as soon as the operation in Lyari began and a torture cell was discovered at “one of his children’s home and office.”
Sabzwari said that operations against terrorists and miscreants must continue across the board to end violence in the city.
The issue of ethnic hatred
Sabzwari said that no member of the MQM or Altaf Hussain were against the Pashtuns or any other ethnicity, and that the Pahtuns were their brothers.
“It is Zulfiqar Mirza who is conspiring to create a rift between Pushtoons and Muhajjirs” he said.
The MQM leader said that there had been no rifts between the Muhajir and Baloch communities, and alleged that Mirza was conspiring to create ethnic divisions between the two communities.
Truth and the Quran
Before the Q & A session, Sabzwari said he had his hands on his seat and not on the Quran.
He said that he did not need to prove that he is speaking the truth by placing his hand on the Quran and it was the trust and support of the people that proved the party was truthful.
He added that MQM members were not like those who had lied to the point that they would have to hold the Quran or “raise the holy Quran over their heads” to make their point.
Sabzwari called on MQM workers to maintain peace and calm in this time.

Yar, Pirzada clearly lied to Supreme court, he said there are 2.5 million foreigners in Karachi, he named many nationals excluding Afghani and/or indians... how can that be, when he mentioned Brazilians but not Afghans/Indians ?

now lets assume even if CJ gives or punishes someone, the government would be defiant like it has been in 17 cases... they have moral power but they cannot enforce their decisions through a politicized police, their last hope still resides with Security forces... if they come down to take action...which would be a extreme decision....

neutral analyses by Najam sethi "" i Gather Zardari was using mirza and malik playing good cop bad cop , it has started to back fire as 1 cant play double games for long . Therefore Zardari decided to choose malik for the time being ..and mirza was let go For now its Malik since the elections are 1.5 years away however there is a little chance we may see zulfiqar mirza in future

Karachi violence case: Apex court to resume hearing from Monday

The Supreme Court’s larger bench will resume hearing of the suo motu case on Karachi violence from Monday in a bid to improve law and order in the metropolis which has witnessed the worst incidents of target killing.
A five-member larger bench headed by Chief Justice Iftikhar Muhammad Chaudhry, comprising Justice Anwar Zaheer Jamali, Justice Sarmad Jalal Osmany, Justice Amir Hani Muslim and Justice Ghulam Rabbani had adjourned hearing of the case till September 5 on the request of federation’s counsel, Dr Babar Awan.
The court had directed Sindh police chief, Wajid Ali Durrani to submit a report on the FIRs registered during the past month after Eid holidays. Awan had contended that he wished to celebrate Eid with his family.
The bench accepted his argument. During the course of hearing of the suo motu case on Augus 29 and 30, the court had grilled Durrani for submitting an incomplete report on Karachi’s law and order situation.
A three-judge bench headed by the chief justice and a division bench headed by Justice Anwar Zaheer Jamali will hear routine cases at the Karachi registry after the suo motu case. The chief justice has constituted two division benches, one in Islamabad and one for the Lahore registry. The division bench in Islamabad comprising Justice Nasirul Mulk and Justice Tariq Pervez will hear important cases including the missing persons’ case in the coming week. The division bench, Lahore, comprising Justice Tassaduq Hussain Jillani and Justice Jawad S Khawaja will hear requests for review, restoration applications, family issues and bail cases throughout next week commencing Monday.
