Punjab police register FIR against 7-year-old for kidnapping 30-year-old!

Full credit to them for doing their job,kids nowadays can be very dangerous.

Having said this, in this case, along with Police, our system is to blamed more then that. All above posts are rightly finding it funny, bu i am afraid they are not familiar with FIR procedure.

When someone come to police station to report a crime, the FIR is registered. The informer, which should be a direct party to the crime, mention suspects in FIR. Once FIR is registered, the work of Police starts. Police appoint an Investigation Officer, whose job is to arrest the accused, collect evidences and make his investigation report. The case is then presented in lower courts which is headed by Magistrate. After arrest of any suspect, Police is bound to present the accused in front of Magistrate to get remand for investigation.

Now, obviously, here is clear malafide intention on the part of accused part, because they pointed out this child as a prime suspect in their FIR. How can Police tell the age of a person, whose name is mentioned by accuser as suspect in the FIR? They can even mention the name of a dead one. Obviously, things become clearer in the course of further procedures. There is sentenced also for false FIR. and lots of other legalities.

Its not only the Police to be blamed of, lots of other factors and legal lacunae. So chill out guys, the child will not be going to jail.

Atleast in India, it is not mandatory to arrest accused in all cases based on FIR. Only after investigation and if the officer believes accused is prima-facie guilty, danger to others or likely to abscond that an arrest is made. Some exception was anti-dowry law which mandated arrest and SC stayed that aspect after 3-month old babies were arrested. Now I think police are arresting for assaulting women right after complaint..
