Proposed bill seeks penalty for false accusations of domestic violence

A bill proposed in Khyber Pakhtunkhwa (KP) to prevent domestic violence states that any woman wrongly accusing her husband of being involved in violence will be penalised with Rs50,000, a local news outlet reported on Tuesday.

Similarly, any man found guilty of violence will have to pay a fine of Rs30,000, in addition to a three-month imprisonment.

The draft of the bill further states that any man who threatens his wife at her workplace or office, through social media, mobile phone or the internet in general, or threatening the woman’s relatives, will be liable for punishment.

In an event of developing a misunderstanding with his wife, a man will have to guarantee his wife’s safety, while he will have to continue to provide food and other necessities to his family. Any case of a conflict, the concerning family laws shall be applicable.

The proposed bill also necessitated committees on the level of districts under the deputy commissioner, comprising of district health officer, social welfare officer public prosecutor and the police. The committee will also extend medical and legal assistance and protection to any victim women.

Fair and balanced bill Much appreciated...similar bill should be passed in NA especially for this metoo. Any women who takes on social media unabashedly to claim about some harassment, she must prove that it happened or pay a huge fine as per the fair assessment of the damage she caused to the person's life and reputation.

Nice ..... money making schemes, State making money (from both parties). I won't call them laws, laws are something that sop, restrict and forbid you from taking an illegal activity, these above provide you the ways how to get yourself out.

Violence is not limited to physical contact, or physical abuse. Physical violence may end at some stage and you may develop endurance to bear it, the real mental torture won't let you live in peace ever.

How can a rich woman prove that her husband slapped her last night? Are you trying to say that its only poor husbands who slap and beat their wives?

We are an Islamic state
There is no annulment of marriage contract based on some law that is other than what is sent down by God. The Nikah is in the court of Allah, not the monkey driven parliament or courts of ours.

Besides you say 50k won;t stop people. But you are sure 3 strike policy will keep people from doing it, in particular the ones who seek to go through the 3 strikes on purpose?

Fear being caught and labelled doesn't matter for people who are habitual of committing an offence, in this case domestic violence. Actually the whole process of law making should be researched based and study based. Reasons why people commit any particular negative act, how many in a society like what is the percentage, how regular, and different behavioral attitudes involved. Making a simple law and including financial penalties in there is no rocket science, where are the measures to mitigate and reduce that attitude to commit the offence.

This is not a solution! You think the one who is involved in domestic violence is interested in 3 strike policy?

The best solution is to educate the woman of her rights...To let her know there is no such thing as getting abused to "save" daddy's face or family's face! No woman should endure such crap for the sake of a family's "honour"!

People need to be taught that Khulla is the right of a woman...If she cant deal with the man then she takes Khulla if the man is abusive then Khulla becomes her haq coz Islam doesnt say stay with an abuser and endure the oppression!

People need to be taught children are not a commodity stop trading them for family favours!
People need to be taught love marriage is ok if both parties are in love and forced marriages are haram coz in Nikkah razamandi is a must not just by tongue due to force from family but by heart coz ALLAH doesnt need your tongue to say kabul against your will!

People need to know that if 1 sibling is divorced it doesnt mean the family is bad (might be but not always) and stop projecting it on the other siblings...THIS makes the elder one to sacrifice living under abuse coz Khulla will affect the younger siblings

So if you want to really discuss what needs to be done...The whole society needs to be taugh of basic rights as a human and of Islamic rights of nikkah and other rights as a parent, as a child as a citizen!

Lets put it out there:

People have pathetic understanding of Islam = pure ignorance of basic rights given to them
People care about izzat and ghairat more than their children = children have to sacrifice and live under oppression
People dont know about Khulla is a haq not a taunt or a dhamki like how many have used talaq to be
People need to know TALAQ shouldnt be used as a dhamki or play with those words
People need to be careful with their words if they cant control themselves, they shouldnt get married
PARENTS need to know if you cant control your cursed son, no one else's daughter should carry that burden
PARENTS need to know, it is ok if your daughter cant deal with oppression...she is a human not a cow
PARENTS need to know that if xyz's home has a divorcee it doesnt mean rest of their daughters are evil and shouldnt marry your child there
PARENTS need to know Prophet HIMSELF married women who are older, divorcee, widower....Do you think you are far superior than a divorce/ widower or even the Prophet himself that your child cant marry older, divorcee or widowed women?

PARENTS need to know you dont interfere/ control your child's marriage UNTIL and UNLESS he is abusive then jump in by all means not to save him but to stand in haq

PARENTS need to know their child is not an angel if someone says he is abusive - INVESTIGATE if you have the brains if not let the police do it and you pay up! Hiding it wont do anyone good nor save his soul!

THAT is why control is a must...The problem with Pakistan family is they do fakka and call it roza...You see each thing ALLAH asked us to do is to make us a real mard ka bacha!

Do prayers = time management (in West Muslims manage their jobs with namaz in mind coz they only get so much free time to say the fard)

Do roza = discipline and abstaining as well as develop empathy

Do Hajj = unity and see the different people ALLAH made, follow the path of the prophets

Giva Zakat = humble yourself and develop empathy

BUT Pakistanis find shortcut in everything....
Prayers = not many pray or even know its essence -Many do takar mar style
Roza = Many do Fakka of being hungry and not doing anything else
Hajj = so many go for hajj pushing other people as though by pushing you get more haq
zakat = many even run away from this

There are other such examples of simple things with some background that people dont associate with it!


Likewise, this law is to reduce domestic violence I would like it to be backed with a registry like sex offenders are registered ....people who beat others should also be registered but then again I have fear that some idiots would abuse that...Like putting someones name on it just so that they cant get married to their daughter or to a girl they like ...
