The Indian Air Force (IAF) on Monday informed the Chandigarh Bench of Armed Forces Tribunal (AFT) that it has sought the opinion of the Ministry of Finance on the financial viability of granting Permanent Commission to male and female Short Service Commissioned (SSC) officers.
During a resumed hearing in the case of denial of Permanent Commission (PC) to Chandigarh-based 12 Wing woman officer Wing Commander Vineet Lamba, the Air Force informed that as male SSC officers had also sought PC, it was now up to the Ministry of Finance to decide on the financial viability of creation of new posts.
The Air Force has earlier informed Lamba that according to the March 12, 2010 judgment of the Delhi High Court, only those women officers are eligible for PC who had approached the court by filing petitions or retired during the pendency, and who were recruited before the issuance of Human Resource Policy, dated May 25, 2006, and had applied for grant of PC. It also added that as Lamba did not opt for PC, she was not considered for it.
Lamba, an Aeronautical Engineering(Electronics) officer, submitted in the court that that she was never asked or offered to exercise the option for conversion from SSC to PC.
The IAF had stopped grant of PC to SSC officers, both male and female, from May 25, 2006. Later, on September 26, 2008, the government cleared PC prospectively for SSC (women) officers in Accounts, Education and Administration (Legal) branches. Later, after the Delhi High Court order on March 12, 2010, those recruited before May 26, 2006 HR policy were allowed Permanent Commission.
