Dhaka, Dec 23 (bdnews24.com) – Judiciary is the most corrupt service sector, says a Transparency International, Bangladesh (TIB) household survey report.

The Berlin-based corruption watchdog in its report 'Corruption in Service Sectors: National Household Survey 2010' says among the judiciary, the High Court is where exchange of kickback takes place the most.

TIB executive director Iftekharuzzaman revealed the report at a roundtable held at the auditorium of Bangladesh Institute of International and Strategic Studies (BIISS), Dhaka on Thursday.

The survey was conducted on 6,000 households in 64 districts from June 2009-May 2010.

The report says 88 percent households of the country have been victims to judicial corruption while 79.7 percent have suffered due to corruption in other law-enforcing agencies.

Besides, 71.2 percent households have suffered due to corruption in land administration, 51.3 percent for taxation and value added tax (VAT) while 45.9 percent for corruption in power sector.

Each of the household paid Tk 7,918 in bribes on average to the judiciary, a bigger chunk of which was spent in the High Court.

The report says 73.6 percent households gave bribes to the High Court, 58.9 percent to the Magistrate's Court and 58.4 percent exchange bribes at the Judge's Court.

Of them, each household provided Tk 12,761 on average to the High Court, Tk 6,598 to the Magistrate's Court and Tk 6,178 to the Judge's Court.

Other than these, 56.3 percent household had to pay bribes for quick disposal of cases while another 32.7 percent bribed to manipulate verdicts.

The TIB conducted a similar survey in 2007, the results of which showed that judicial corruption stood at 47.7 percent while 96.6 percent corruption by law enforcers.

The new survey shows corruption has declined amongst law enforcers while judicial corruption marked a rise.

According to the report, corruption is higher in rural areas as 87.5 percent of the households in villages face corruption while only 79.3 percent in urban areas.

Service sector-wise analysis, however, shows law enforcers were ahead in taking bribes while illegal money collection 68.1 percent. Land administration followed closely with 67 percent, while judiciary 59.6 percent and income tax, VAT and excise division 43.9 percent.

The report also says the total estimated bribes and amount of illegal money collection nationally was Tk 95.91 billion, which averaged Tk 3,184 per household.

In reaction to damming report on judicial system, Awami League state minister for law Kamrul Islam accused TIB of taking side of “war criminal”. It is important to know TIB is a Berlin, Germany based int’l organization focused on investigate and report annual corruption index for different countries in the world. Awami League minister failed to explain how an international organization has anything to do with “war criminals.”

Law minister says survey 'misleading'; DMP boss questions its credibility

The law minister and police authorities yesterday heavily criticised the survey report of Transparency International, Bangladesh (TIB) about corruption in service sectors.

Law Minister Shafique Ahmed said the TIB report claimed that the judiciary was the most corrupt service sector but it is not true and it is misleading.

Meanwhile, Dhaka Metropolitan Police Commissioner Benazir Ahmed at a press conference questioned the credibility of the report and said it was published with a motive.

Law Minister Shafique Ahmed said it is not clear in the TIB report how it prepared the report on the entire judiciary, he told The Daily Star yesterday.

He said the TIB report did not categorise people in the judiciary like who were the recipients of bribes and who gave bribes.

He said the TIB brought such allegations against the entire judiciary talking to only a few people and this is not right.

The minister said appropriate actions are taken against judges found involved in any kind of corruption.

He said many litigants from rural areas fall victim to brokers at courts but the judges do not know that.

“The judiciary is an autonomous institution and the judges do not take bribes. The [TIB] report is not acceptable in any way,” said State Minister for Law Qamrul Islam at a discussion and reception for certified freedom fighters.

Qamrul said, “The TIB report has questioned activities of the judiciary intentionally to indirectly hinder the trial of war criminals...” He urged the TIB officials not to speak in favour of those who are hatching conspiracies to foil the trial of war criminals.

In the same discussion meeting organised by Bangabandhu Academy, Industries Minister Dilip Barua said the government will arrest alleged war criminal Ghulam Azam (former ameer of Jamaat-e-Islami) before the next Independence Day (March 26).

“The arrest of Salauddin Quader Chowdhury was a Victory Day gift to the people from the government,” he said.

Qamrul, meanwhile, described the Anti-Corruption Commission (ACC) as an impartial and independent body. He claimed that the government neither influenced the organisation nor has any intention to influence it in future.

Denying the allegation of torture on BNP leader Salauddin in police custody, Qamrul said Salauddin misbehaved with policemen and the BNP demands international interference in this issue only to tarnish the image of the government.

Meanwhile, Benazir Ahmed at a press conference at DMP headquarters termed the TIB report motivated and questioned the credibility of the report. He said, “It was prepared on the basis of perception, not investigation.”

“Those who conducted the survey were neither skilled nor did they go through all the required steps for any survey,” said the DMP commissioner.

He mentioned that Bangladesh police are leading the peacekeeping missions of United Nations for the last three years and in the last 20 years, no policeman was repatriated on corruption charges.

“If police were so corrupt, the United Nations would not have put Bangladesh police on top, ” he said, adding, “This TIB report will tarnish the image of our police force with the international community.”

A TIB survey yesterday said the judiciary and law enforcement agencies were two of the most corrupt service sectors in Bangladesh.
 
Few months back I had started a thread how Awami league regime turned Bangladesh justice system into kangaroo court. I had to take lots of abuse for opening the thread. Now an independent body TIB reveals and validates what had been posted here. Perhaps, pakdef can take credit on coming before TIB.

Please be neutral when you make a post. Do you want us to believe that the Judiciary became only after AL came to power. Why do you make people laugh by such an assumption?

But same TIB was praised by same Awami league when TIB reported against BNP regime. Any one or any organization being label as War Criminal if it goes against Awami league. Awami even called Aalim and Uleama war criminal when they raised question about the anti-Islamic education policies.

You can take facts and figures and go both ways. First of all, since the last report, there has been a few wars and famine in the world causing more poverty. Crime rate in other parts of the world have increased due to undeniable racial tension between the muslims and the western world.

Except for Afghanistan and Iraq no other countries in the list have faced the 'racial tension' as mentioned by you, and they have been facing the 'racial tension' since long before 2005.

Gahh don't you guys ever get tired of creating propaganda threads. Why there is such mono-dimensional façade of Bangladesh in this forum? There's supposed to be different views and opinions.

Time again Awami league govt has proved its indian stooge agenda. So indians defendeing Awami league regime and its acts further highlights indian stooge relationship. Carry on.....

Corruption in service organizations

The statement that corruption in this country is widespread or endemic or systemic does not surprise most people who do experience the malice everyday while seeking service from state organizations or institutions. But what has been revealed by the latest household survey conducted by the Transparency International, Bangladesh (TIB) would surely come as great shock to them. The TIB survey has put the country's judiciary as the most corrupt institution, closely followed by the law-enforcing agencies. The observation coming from none other than the head of the country's anti-graft body-the Anti-corruption Commission (ACC)-who was present as the chief guest at the publication ceremony of the TIB survey findings in Dhaka Thursday last, would heighten further the citizens' frustration. The ACC chief said the problem of corruption is far more severe than what has been revealed through the TIB survey and he guesstimated that black money had taken hold of almost 50 per cent of the country's economy.

The incumbent chief justice of the country only recently pointed his accusing finger at country's lower judiciary for indulging in irregularities, financial and otherwise. But the latest TIB survey has found the higher judiciary to be even more corrupt since respondents who took recourse to litigation reported that they had spent larger amount of money in the high court than lower courts on bribes. However, there are always scopes for interpretation of a perception-based survey either way. Some people might find the survey results to be amply reflective of the actual situation while some others might dismiss the same as nonsense. That is what has happened in the case of the TIB survey finding on law enforcing agencies. The Commissioner of the Dhaka Metropolitan Police (DMP), giving his reaction to it last Friday, not only rejected the finding results, he also questioned the credibility of the TIB as an entity. However, such reaction would have carried more weight had it come from the police chief or someone from the ministry concerned.

The publication of the latest survey results, expectedly, has also provoked angry reactions from the ruling circle. Similar reactions had also come from the ministers of the past BNP-led alliance government following the publication of the Transparency International's reports on the global graft situation, placing Bangladesh at the top of the list of most corrupt nations for three years in a row. Undeniably, one can raise questions whether it is right to draw a conclusion about an institution such as judiciary on the basis of the responses from a handful of people, leading to a meaningless war of words between the people supporting or opposing the TIB findings. But the fact remains that the people do not hold the service organizations in esteem because of their inefficiency and corruption. Actually, everybody seems to be interested in describing one organization or the other as most corrupt with none caring to initiate any corrective measure to rid the nation of this malaise.

Corruption, which is linked to man's inherent greed instinct, is such a vice that it cannot be eradicated overnight or in full from any organization or any country. However, the extent of its presence is very much related to good governance. Judiciary and police are institutions that play key role in ensuring good governance. There are reasons to be worried if they occupy the top two places in the list of most corrupt institutions. What the situation demand is concerted and useful effort from all concerned to bring about a change in the situation and make governance relatively effective.

The current index has more to do with the previous Care-taking Govt. than Awami league. AL actually made the anti-corruption (ACC) into a toothless tiger against all the advices and warnings. They withdraw most of the cases showing a lack of evidence, but kept most of the cases against BNP.

You just don't get it do you? Bangladesh should not have even been in the ranking because its a healthy democratic country. The hate in most countries can easily be identified and racial tension is one of them. Crime rate is high because of indoctrinated hate caused by recent religious extremism, fierce dictators and likewise ideologies. Bangladesh does not fit in any of them, which is why being in the same list is humiliating. Back when Bangladesh was ranked number 1, this tensions in other countries were relatively low.
For your information, Bangladesh's crime rate is very high at the moment. I know its hard for you come across this, being a sheikh hasina supporter and an Indian, but look at the recent transparency international articles about police and the judiciary system.
And for the mono-dimensional point of view is not only in this forum and it is spreading slowly and undeniably. Loots, murders and rapes are high as ever. Few months ago, I read an article about how an awami activist celebrated his 100th rape victim openly, whilst the cops refused to take any complaint about the chatra league activist. This seems like only one sided stories, but crime during the last bnp/ army regime seems peanuts now when you hear about the chatra league clashes WITHIN THEMSELVES.
Anyways, we all have different opinions and views as I disagree with many people in this forum, but you can't disagree between black and white. On the contrary, I would love to see an Indian Hindu side with a BNP/nationalist/anything which is not awami league for once without making bigotry statements.
