'Extremely disappointed': French court gives green light to bone age tests for child migrants

France's Constitutional Council on Thursday approved the use of bone age tests by authorities trying to certify whether young migrants should qualify for child protection services, a practice that has been assailed by rights groups.

The Constitutional Council, which decides on the validity of laws, nonetheless recognised that such testing was not completely accurate, and said results could not be the sole factor in determining a minor's age.

"The person being tested gets the benefit of any doubt," the court ruled.

The case involved a Guinean migrant, identified as Adama S., who arrived in France in 2016 and claimed to be 15, which entitled him to the care of child social services.

Adama refused to submit to the X-ray tests, which are used to help determine an unaccompanied minor's age and require consent under French law.

The tests, originally developed to determine a child's skeletal maturity, are widely considered to be less accurate with older children.

The next year, a juvenile court in Ain, southwest France, ruled that Adama was an adult and removed him from the welfare services.

The number of unaccompanied migrants arriving in France claiming to be minors rose to some 17,000 in 2018 from 6,000 in 2015, according to the Interior Ministry.

In the absence of legal documents, there are few alternatives to the bone tests for accurately assessing a person's age.

But critics say the practice can be used to deny entry to young migrants who should benefit from France's protection under international law.

"We're extremely disappointed," said Clementine Bret of the Medecins du Monde (Doctors of the World) aid group, one of the plaintiffs in the case.

"We would have liked to see France honour itself by following the examples of Spanish and English courts," which have outlawed such testing, Bret said.

Such abuse will continue no doubt , it is why rebuild of Syria is needed

Muslim nations need to wake up and understand Europe will not take unlimited amount of migrants. I mean they don't want migrants from Africa or Syria it is same to them

Provided Syria is rebuilt the refugees will have chance to return to their own country

Of course rebuilding of Syria will happen, but not because of your stated reason.
 
The issue for France is Migration , they don't want African migrants or Syrian
These loop hole decision they are introducing in their law is just a way to discourage migrants

Or anyone getting free payouts , instead of working (which migrants can't work due to laws sometimes forcing them to go home)

Not long ago there were demonstrations in France people were complaining about Economy
it lasted for 30-40 days

Ultimately the best place for Syrian Refugees is their own home , provided their nation gets help to rebuild

The problem is US interference. As long as the US continues to interfere in the Middle East more refugees are created every day.

They can't fool the masses. They created the wave of migrants which wasn't there before Iraq, Syria and Afghanistan. Economic migrants will always be there, but not remotely in the numbers we are witnessing.

Usually America loves to fulfil this role, but very unlikely that this will happen under Trump.
 
Trump's goal is simple he in his mind he thinks is is some sort of savior and before he dies Jesus will come and crown him or kiss him on his cheeks so he blindly supports Israel

In fact, it is very profitable to rebuild the country. Remember the Marshall Plan. The USA is in great advantage after rebuilding Europe. They still controling European states. Every cent spent on rebuilding country will turn as dollar.

The problem is simple to solve. People need to provide proof of their age, when in doubt.
If they cannot provide proof, then they will have to accept whatever methods are used to determine the age.

Russia has likewise created the problem by supporting the genocidal Assad government.
Even the Russian Foreign Minister considers the elections in Syria a joke.
Russian involvement in Syria is orders of magnitude higher than that of France.

Yes Libya was a mistake,but Libyans created this own mess. Can't get their shits together and build a functional state,instead chose to fight each other. No unity,what do you expect ?

As for Syria,that's the funniest one. Bashar bombs and gas his own people,destroys entire cities but that's somehow the fault of "the west". By your logic Russia is also responsible for the current migration wave giving your armed forces have actively participated in the destroying and carpet bombing of Syrian cities,even more seeing the bombs you are using.
